My wife and I decided to stay at a local hotel today for some alone time away from the kids, so around 9 pm I go out to start my truck warm it up I went around to the passenger side to look at my muffler and bend over my shirt comes up I assume and exposes my glock in Iwb and what looked like a hooker and her boyfriend sitting next to me. They drive off as normal I'm sitting there waiting for the wife to come out I hear sirens and see a cruiser running lights up the main street and I start thinking ok then I hear another one from the other way. She comes out and gets in and I take my wallet and place it on the dash and we pull around the corner and see 9 police cars sitting and them about 12 cops walking with guns drawn and a few ar-15s so I pull slow towards them one runs to the side of the building they all focus on my vehicle weapons pointed so I stop. Officer yells open the door so I comply I start to get out and yells stay in the vehicle. Ok then he yells get your hands in the air and exit the vehicle as I'm doing that I yell I have a ccw permit and am armed he tells me to face away from them and walk backwards to them so I do it, he tells me to stop and get face down on the ground as I'm doing that again I tell them I have a ccw permit and am armed he yells to me and says SHUT UP as I'm laying on the ground I look at the officer and say shut up he says YA SHUT UP and don't look at me so I stare at him. I hear a lady officer tell me to put my hands behind my back I tell her I don't want to do that as my weapon is on my side in a holster and don't want my hands near it, she comes up and rolls me on my side and takes it then has me place my hands behind me and they cuff me extra tight I will add. Then they have my wife exit the truck with her hands up and have her walk over and place her in cuffs very loose hmmmm. They ask for my Id I tell them my Id and permit are in my wallet on the dash they grab it run my name run the serial on my gun and look at my gun registration and say we want to make sure its not stolen Um the serial number and my name are on the registration anyway as they do that a officer says we get a call of a guy playing with a gun Ok and we get alot of hotel robberies so we have to check things out so they ask me what I'm doing there I explain and they say ok he walks over to a supervisor and tells her what I said and another officer asks me what I am doing there to see If the story matches so the checks come back and one cop says when I give you your gun back your not going to shoot us as we leave. Then they start being cool with us and say the standard we have to check things out I tell them I understand but think they need to handle things a little different. One when a person yells I have a permit and a weapon I know they have to act a certain way but like a ccw permit holder is going to rob a hotel Two I don't think when you inform them you have a permit they should tell you to shut up I was a little pissed off about that Three Its been over a hr since they placed me in cuffs I still have cuff marks in my skin. They never asks my wife for her Id and after all that they go do you have anything in the truck I say no he asks mind if I look thru it I said help yourself I have nothing to hide. I understand ccw is new here but damn what a headache and I dont think a person needs to be talked to that way. After they seen I was military they said thanks for serving and was nice but it doesnt excuse the way I was treated. At the very end I was told they got a call of a guy playing with a gun.

So if you are carrying a gun that is not registered then you would have been in trouble?
I was to the understanding that Nebraska Statute Section 18-1703 eliminated that.

1) Take an extra pair of undies, cause I bet you needed them when this ended. I know I would have...... 2) DON'T QUESTION A LEO(S) WITH GUNS POINTED AT YOU.....PERIOD. You can be mad later on, but possibly dead before that. 3) DON'T EVER CONSENT TO A SEARCH OF YOUR VEHICLE !!!!! If they ask, that means they don't have probable cause or reasonable articulable suspicion. Even if you have nothing to hide, protect your rights. You might be that one individual in a crooked city that something planted. 4) Save up and take you wife to nicer digs. Sounds like you were in a part of town you shouldn't have been. 5) It will be a datenight you will never forget. |

Actually bullit this happened in west omaha where we live and so Im not so sure what a nice area would be anymore, yes I did need a extra pair of undies and I
was torn on letting them search my vehicle I new they didnt have jack on me but figured they would hold us up there even longer so I allowed it. I still feel
the ar-15's and so many officers were just over kill and un needed for one guy I dont think OPD has a policy on CCW yet and how to handle it but Im hoping
they visit that topic very soon. And Movado I am not sure on the answer to your question I dont think they understand yet about the statute that overrides
their gun registration I did explain that to them but they didnt get it. Lucky that my weapon was already on file with them even though it isnt needed anymore.
I think I will call and see how far up the chain I can get to have them look at their CCW policy so the officers can understand the law since they have no
clue.

As I read your post again, I am not sure the problem lies with OPDs handling of your "situation" as a CHP holder or Omaha policy. I think the mere fact you had a firearm, and this was reported to them via a 911 call, they were out to "kick butt and take down names later". They handled it in a way I think a responsible manner based upon the information (however correct/incorrect it was) given to them. Again, I think the best thing you and your wife experienced was not being shot. Finally to me the "teachable moment" for all of us is to keep low key on the carrying of a firearm. I think bullrider experienced a situation where someone whether being a Dudley Do-Right, a criminal themselves, or just plain nosey got him in a bad situation. Thus my personal philosophy about no posting firearm, NRA, etc. stickers on my vehicles. Also, I don't wear gun related clothing. |

BAD idea. You could have David Kofoed or one of his buddies do the search. You were in cuffs, so they would find something to prove you needed to be in cuffs.

bullit, I need to disagree, Bullrider was doing nothing illegal. Yes, police need to respond to a man with a gun call, but having a gun is not an illegal act.
They need to come and proessionally investigate, that includes treating any possible suspect with the respect due to their boss. That is who we the taxpayers
are, their boss. Without the information from the 911 call we do not know on what information the police reacted, so at this point I can dismiss the fact that
there was multiple units responding but they still needed to treat Bullrider and his wife with respect and professionalism.
Bullrider, I would contact an attorney and see if I could not get copies of the 911 call and the dispatcher sending officers to the scene, they stepped all over your rights. This is why the police get called a bunch of Jack Booted Thugs. |

Catfish I have contacted the Chief of police and left a messege if I dont hear back I will contact internal affairs and have them look into this matter. I
dealt with them one other time for a dui off duty officer and they were great the police officers on scene tried to cover it up and after IA got involved and
we went to court the officer was fired the others involved where all suspended if anyone would like to hear the details on this story let me know and I will
share it with everyone! It really is a great story and will blow your mind how the event unfolds and leave you shaking your head.

Ok the cover up story this happened a few yrs ago here in omaha. It was about 11:45 at night I was west bound on center st about 120 th street at a red light a
car was turning to go west I was in the slow lane a car comes up along side me almost clips my car runs the red light and barely misses the other car turning
to go west, about a blk and half away the car pulls over and a guy gets out staggers and falls in the ditch I stop and so does the other car that was almost
hit and then a yale security car that was parked in the lot who witnessed it all comes over to help keep in mind we think the guy is having a medical emergency
heart attack or something we get to him and smell strong odor of alcohol he is drunk to where he cant stand. I tell the other guy to call the police I hold the
guy down as he keeps trying to get up I tell him to stay down so he doesn't hurt himself he then tells me to let him up he is a cop he starts reaching for
his ankle I pull his hands away and reach down and feel a gun so now there is no way I'm letting him up or going to allow him to move his hands so the
other kid see's what is going on and helps me restrain him I see in his wall his badge and Id OPD. The police finally arrive and right away nothing is done
by the book the know who he is they help him up walk him over to the cruiser another pulls up gets out and they are he is hugging the other officers. They
place him in the police car and come up to us ask our names we give the info but they are not even writing it down then they thanks for everything you guys can
go I pull up the street and park in a lot and watch as one officer gets in the drunk guys car and they all drive off. I call the police main number 444-5600
and ask for shift command in the west area tell them what just happened he says "WHat" I heard them say on the radio nothing found and they went back
in service he says let me transfer you to internal affairs I reach them explain the details they say we will look into it 8:30 the next morning I get a call
from them it all comes out they say there will be court appearances and more investigations the other two people at the scene with me I did exchange numbers
with and they were contacted too. So a month later after we all got subpoena's to appear we go in and the cop is on stand and says I says I want to change
my plea to guilty but the reason I was drunk was I was the first to respond and get to the officer who was shot in the head J.W.Jr the judge yells at him and
says you almost killed some people on this night no excuse and then goes off on the cover up he says you are to be removed from the force get a full time job
and attend alcohol treatment or I will put you in jail his wife stands up and yells he cant work he needs treatment for stress and you should pay for it she
had a big attitude and was a real winner the judge says he will work full time and follow my orders or jail you go she stormed out the room. We were told since
he changed his plea to guilty we didn't need to get up on the stand and they said all the other officers involved were suspended and other action done I
think one other officer was fired. The reason you may never heard about this one was it was a closed hearing so if you were not on the list you didnt get in
the court room! Very hush hush.

I think I would have contacted the media on that one.
Might not be a bad idea on the recent incident as well, depending on what kind of response you get from OPD.

Wondering out loud.....I seriously wonder if the other people that left the area, were, in fact, PERPS who were going to hold up this hotel, saw you were
carrying, and thought twice about it, and then turned you in.
Sorry on the rest of the incident, but, if you were in the officer's shoes, how would you handle the situation? Yes, there should be a little more professionalism about it. In terms of CCW....I would not care if the person told me they have a permit or not. Until the officer has the situation under control, everybody needs to follow instructions.

Wow, I bet your mind was spinning. Here's what got me, and I realize with the nature of the situation I might have done the same thing. But allowing OPD to search your vehicle... You just gave up 4th Amendment (Unreasonable Search and Seizure). Again, I'm not sure at that point I would have argued and belabored a longer unnecessary ordeal. No matter what I think, thanks for sharing your stories (both). I'll be more alert because of it. |
