Not sure if he will sign it actually or when. I believe he has something like 5 biz days to sign it or veto it and then it just becomes law if he doesn't

5 days excluding Sundays. Since the bill was presented to the Gov on 5/13, it appears that it is now law without him vetoing it. Strange that it hasn't
been reported as signed by him.....

I just bought a Sig 250 from Cabelas.
I should be getting my ccw permit in the next 2 weeks, do I wait and not register this handgun, or do I have to register it still? I live in Omaha.

If you are CCW'ing with it and get pulled over in Omaha, you are screwed. Even after the law takes affect you could get nailed because you actually would have broken the existing law at the time of purchase. I see nothing in the law that is retroactive to Omaha's purchase and registration laws. YMMV |

Movado I think Omaha requires us to register within 14 days. I have been in after that period and had no problems but try to get there within that time frame.

Shoot I did not know that...The first time I registered a handgun it was like 2 months after I bought it.
The officer did not say anything to me about a time period, this is why I asked about the wait until after LB430. Thank you mtncrash1

I'm struggilng with the same decision as Movado. Only difference, I live outside of the city in Sarpy county. So legally I don't have to register it as
long as I never take it into Omaha. I have other carry guns. Would you guys just wait to start carrying the new one until after the law is in effect?
I bought it at Cabelas more than a month ago. Then I started travelling for work, so I'm well outside any 14 day period. -Brian |

Today is listed on the legislative agenda as the last day of this session. If so, LB 430 should become law on August 27, 2009, if I can count to 90 correctly.

Since you live in Omaha it would be best to register it. I am a Bellevue resident and will now not need to have a registered gun while carrying concealed in
Omaha because of the concealed carry permit. I did however register three of my carry guns over a year ago, because of the former status quo. Now the way I
read the law, you would think the carry permit erases all the ordinances, and granted you may not have a problem while you were carrying concealed. However I
could see a problem coming in when you are not carrying it concealed and it is just at home and for some reason you would have police contact and they would
ask you about your firearms if they are registered or not. Since you weren't technically carrying them concealed on your person in your home, they might
sight you for braking the ordinance. I personally think the ordinance is unconstitutional anyways and does no good whatsoever (it does not stop gun crime) and
could lead to confiscation in the future if the Omaha government decides to ban handguns or any guns for that matter within their city limits in the future
(Chicago did it, San Francisco did it, DC did it, and resently New Orleans confiscated them in light of the Hurricane). If you have your guns registered they
know where to come to to take them away. I live in Bellevue so they can't touch me since it's not their jurisidiction. Bellevue does not have a
mandatory registering requirement although their city ordinance encourages it.
This is why I was angry when the committee and the legislature voted to change the wording of the original bill to only apply to holders of the concealed carry permit. The original (green copy) of the bill stated that "cities, villages, towns shall not have the power to regulate the ownership, possession, or transportation of firearms". Then it went on to say something like "Any existing ordinances, permits, or regulations regulating the ownership, possession, or transportation of firearms are hereby declared null and void". So had the bill passed with that wording all gun related ordinances or city codes would have been null and void including Omahas requirement to get a permit to carry a firearm openly. It would have eradicated Omaha's ordinance that prohibits carry in city parks as well and would have made state law the only law that governs firearms regulation. |
