As one of many of your local supporters in the 2008 and upcoming 2010 elections, I am writing in regards to the recent media debate regarding current CCW permit holders. As a law abiding gun owner, an active member of the Hastings community through volunteer work for the YMCA, education assistant of elementary and immigrant students, a soul proprietor of a local lawn company, a senior at Hastings College in the art of Communication Studies, Public Relations, and advertising, and a sports and recreation shooter, I am more then unsatisfied with the status quo of CCW bans that have overridden local cities in their entirety, specifically and including Hastings.
It has been a long haul for gun owners and for CCW permit holders alike, and our N.R.A. certified handgun training is no different. It took dedication, government taxes for applications and training, and hard work both in the classroom and on the range to obtain these permits. We are certified to carry concealed handguns for defensive purposes and we do not appreciate how our permits have been rendered invalid in certain cities. When this bill took root, it was through the use of democracy by the people. Single groups or municipalities do not have a blanket right to override these legislative votes based on their oppositional opinion of the results (CCW Legislation 2006).
The Attorney General has stated his opinion regarding preemption and has answered Senator Christensen's two other questions clearly regarding CCW permit holders within those very borders. However,many of these cities continue to disregard these clearly stated opinions for Nebraska CCW permit holders within that very Nebraska border. This is not fair legal practice, nor is it what was intended by the legislature contrary to certain official opinions. Kearney has recently repealed their city ban on January 27th, 2009 while mentioning the reason they did so was to avoid a future lawsuit against their city.
Obviously the Nebraska Supreme Court's Attorney General's opinion means something to the officials in Kearney. However, many local city officials continue to disregard Mr. Bruning's opinion on Nebraska state permit holders right to defend themselves and their families. LB-430 has been introduced by Senator Mark R. Christensen. Please take a careful review of the proper legislative steps to ensure that this bill reaches and passes on the floor. It is the only right move, regardless of any existing heated, personal, 2nd amendment opinions some may have. Thank you for your time on this matter and have a wonderful day.
