The Texas legislature (two houses that work perfectly.... hint, hint Nebraska) amended their CHP law early on to place the onus of liability on the premises
owner should they decide to forbid lawful firearms carry in their business. This was in large part due to the actions of Dr. Susan Gratia-Hupp who was a
legislator and daughter of parents killed in the Luby's massacre. As if by magic, most all of the prohibitive signs came down overnight. Another amazing
thing is crime is significantly down in TX, but I am preaching the choir.

Bullit: I'm well versed in how the TX law came about. And I applaud Dr. Gratia-Hupp for her hard work, and am respectful of why she took a stand. While I
have not lived there I spend at least 40 days a year in TX for work. I working with my clients I don't hear from them that their 2 house system has
achieved perfection in legislation.
I think we can all agree that Nebraska needs uniform signage and it needs to put the burden on the property owner. I'm working towards that end. |

I feel in addition to uniform signage, there needs to be uniform instruction like in TX, FL, etc. Knowing several TX instructors from the onset, the logic was to keep CHP carrying "Joe" from blowing someone away and saying "but my instructor said I could shoot someone while drunk in the basement of the sheriff's office". Yes, I am being sarcastic in my example, and in NO way attempting to disparage the instructors of this state their ability to teach. They obviously are doing a fine job. My point is keeping it simple (KISS)....uniform signage, uniform instruction, uniform rules throughout the cities, towns, and villages of Nebraska. Then there is no confusion and the beauracracy lessens. These will continue to be issues that I hope we as a CHP and firearms owning community will stress to our lawmakers when the new Unicameral is seated. By the way, the Nebraska legislature has had a two house system for the last 38 years. There was Ernie versus the Unicameral ! |

Ah it may have been a two house system with Ernie....Yea know I was always told that the Senators were elected as non partisans! But I don't think Ernie
wouldn't even agree with that statement. He was the most partisan Senator there was.
It will be interesting to see what the seating of 15 new "non partisan" Senators will do for the Unicameral. |

Schaefers TV & Appliance is posted.
Went to buy a cook top and some other kitchen appliances, and instead bought elsewhere. I sent them an email asking to have the sign removed... I am not holding my breath... and informed them that I was buying appliances at a competitor that had no signs.

A quick question on the legality of open carry - and a short story.
I was going to valentinos to have the dinner buffet last friday with a group of close friends. Once entering I saw to my dismay the sign stating no concealed weapons. So I was sad to say I could not eat and could not explain why I could not join them. (not wanting to tell them I was carrying) Is it legal to open carry in an establishment that has posted no concealed carry? Vals is good and I would like to continue eating there, but when on a motorcycle it is a little tough to stow your gun safely in your vehicle while in the restaurant, so my only option is to leave

I don't think it is technically Illegal to open carry in a posted place, however I think that would be a very gray line to walk, and may take an arrest,
embarrasment and attorney to get cleared up if one tried it.

I don't know if this has been discussed, but I found two places that prohibit weapons in Lincoln Municipal Code. I assume that includes concealed carry
(with a permit, of course). Please correct me if I'm wrong.

Well I can't believe it, I thought that Best Buy wouldn't succumb to this but they have posted the no CCW sign on their front window. I truly hope
that as many people that say they won't shop in a place that has the no CCW sign, actually so stop shopping there. I know that I have. How would I go
about getting some of the "No Guns = No $" cards? I would like to hand them to some of the management/supervisory staff that I know there.

The Kwik Shop at Cotner and Holgrege, in Bethany, does not trust lawful ccw permit holders with their guns, just criminals who dont care about the sign. I
would assume that all the other Kwik Shop's are the same.

We have discussed this issue and we tend to agree with you. This would seem
to make sure that the only person in the store with a gun would be the one there to hold it up. Please let us know which store has the posting and we will take care of it. A response from Best Buy corporate office in regards to the email that I sent them:
I am very sorry for your disappointment regarding the no concealed handgun sign that was posted at the Lincoln, NE store. Our corporate position is that Best Buy strives to comply with all applicable laws and statues. Best Buy also strives to provide a safe and comfortable shopping environment for all of our customers. Best Buy does not ban guns at our retail locations. As a general rule, Best Buy does not post "no guns allowed" signs in our stores and we are not aware of any individual stores that might have posted such a sign. Our offices will be in contact with the Lincoln, NE store requesting that they remove the sign from their store. Again I am very sorry for any inconvenience this may have caused.
