Does anyone think that the ruling yesterday by the SC will have any effect on the Nebraska towns that have chosen to "opt out" of LB 454? I hope so, but I also know how stubborn my neighborhood city council is (Lexington)! |

No, that decision affects laws that prohibit execise rights protected by the 2nd Amendment. You can always Open Carry. In fact, that is what I did in
Plattsmouth, until they changed the law....... it made more than a few people uncomfortable: I got the "Are you some kind of Cop?!?!?!" question more
than once......... People do not realize that they are perfectly within their rights to carry a holstered pistol on their hip nearly everywhere in the State
(you just need a permit from the Lords of the Fiefdom of Omaha to do so there!).

If I "open carried" in this town, I am pretty sure the "no-weapons" signs would go up in many stores (especially Wal-Mart). The Wal-Mart
manager says it is company policy. Do all Wal-Mart stores have those signs in towns that allow CCW?

The Wal Mart Manager you are talking about sounds to be mistaken. When the South Lincoln Wal Mart store posted a no weapons / no ccw sign, I went in and
informed the Manager that posting that sign is against Wal Mart policy. She called me 15 minutes later to apologize for posting the sign, she had called
corporate and confirmed I was right. Pretty sad a customer knows their corporate policy better than their General manager.

Although WalMart will allow CCW if permitted in your state, they will often ask you to leave if you open carry and scare the sheep

OK........... Maybe I'm misinformed............. Open carry LEGAL in the state of Nebraska EXCEPT ------- Omaha where you need to register your firearm......???? Other than that......SIGNS on businesses that state NO WEAPONS you are not allowed to have one (not the concealed carry crap, but you have to read each carefully....some state no weapons at all........) And of course the not allowed stuff........courthouses.......cop shops......federal stuff.....etc...... ????????????????????????????????????????????????????????????????? Help out..........!!!!! |

A business may post a generic gun sign that tells you not to bring a handgun into their establishment e.g. Kwik Shops in Lincoln. They could post a similar
sign asking you to not bring an umbrella inside either. Neither is to be misconstrued as a LAW. They have the right to ask you to leave, but this likely
would not be prosectutable, nor a violation of your CHG rights. Open carry is "allowed" in Nebraska as their is no state LAW or STATUTE forbidding
it. If their is no LAW or STATUTE prohibiting an act, it by conclusion is not illegal, and therefore cannot be prosecuted. The confusion comes with city
ordinances and open carry. Although the state does not forbid an issue, a city or county might. I was recently at the Lincoln Airport picking up a rental
car. Out of curiosity (and to make him squirm), I questioned the Airport Police about open carry in the entry and lobby (not past the metal detectors to the
gates). He agreed that their is no federal, state, or local Lincoln ordinance that would forbid from such action. However, he let me know one would probably
be cited or detained for "disturbing the peace". Another interesting point to consider would be a county courthouse and open carry. At the
Saunders County courthouse, there is a sign that forbids weapons on the third floor where the courtrooms are. There is metal detector, etc. To my knowledge,
there exists no prohibition of open carry anywhere else in the building. Personally, I would not attempt it, but an interesting thought.
As a CHG permit holder we are told that it is against state STATUTE to carry a concealed HG into a bank. Further, there is the "opinion" this negates us from affirmative defense. However, there is nothing in state STATUTE or LAW that forbids the open carry of a HG into a bank. |
