Q (me): Who does the University Weapons Policy (UWP) apply to?
A (chief): The University's weapons policy applies to students, employees, and visitors...We seek voluntary compliance with policies, as well as ordinances and laws, however we do enforce laws to provide a safe environment.
For those of you who are not familiar with the UWP, it states:
"Possession of dangerous weapons - concealed or unconcealed - on University property, on the worksite, in University vehicles, or in personal vehicles when on University property shall be a violation of UNL policy... In order to maintain and protect the health and safety of UNL property or persons on UNL property, persons who are neither UNL employees nor students who are found to be in possession of a dangerous weapon on UNL property may be subject to immediate seizure of the weapon by the University of Nebraska Police Department and removal from campus. Seized property not held as evidence in an investigation will be returned to the person upon exiting UNL property."
Q: How does the UWP apply to weapons in vehicles?
A: Firearms are not allowed on University property concealed or not concealed, in or out of vehicles. Several of the streets running through city campus are city streets, maintained by the City of Lincoln, and are not owned by the University. These streets would not fall under the University's weapon policy. However, there are a few such as 15th, parts of U, S, 14th and Vine, among others which are University owned. All of the streets on East Campus are University owned streets, so the weapon policy would apply.
Q: Does Nebraska Statute 69- 2441 (2) exempt Concealed Handgun Permit holders from the UWP by allowing them to carry in their while on University streets or property?
A: I believe the exemption language of 69-2441, Section 2, that you refer to applies to the similarly worded last two sentences of Section 1a, ; ...a place or premises where the person, persons, entity, or entities in control of the property or employer in control of the property has prohibited permitholders from carrying concealed handguns into or onto the place or premises; or into or onto any other place or premises where handguns are prohibited by law or rule or regulation.
This exemption applies only to those additional locations that the owner or controller designates a prohibition on concealed handguns and which are not specifically identified in the statute. This exemption would not apply to those locations where concealed handguns are specifically banned in Section 1a.
